A special exception may be generally granted if the applicant shows that the proposed use cannot be authorized under the applicable zoning ordinance without serious detriment to the public welfare or substantial impairment of the integrity of areas protected by the zoning ordinance. A conditional use permit may be generally granted if the applicant shows that the proposed use conforms to the applicable special exception standards and that the use is consistent with the adopted comprehensive plan and the applicable Zoning Ordinance.
For an area designated as a residential development, within a zone designated as a rural residential zone, upon application of a property owner, and after a public hearing, the governing body or the board of zoning appeals of the City of Norfolk may grant a conditional and special exception use to permit one or more single family dwellings as defined in § 3.2-6400(1), and accessory use structures. The size of the single family residential dwellings shall be limited to 0.5 acre or less.
A zoning ordinance shall not require that a special exception or special use permit be obtained for any agricultural production activity (including harvesting) in an area zoned as a residential district or classification.
